                   A  BILL  FOR  AN  ACT
RELATING TO TEACHERS.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  The purpose of this Act is to repeal the sunset
 
 2 date for the Hawaii teacher standards board, thereby making that
 
 3 board permanent; to repeal the sunset date for the law providing
 
 4 for the issuance of certificates to teachers who are not required
 
 5 to obtain a license or credential from the teachers standards
 
 6 board; to provide for more specific enforcement of penalties for
 
 7 hiring unlicensed or uncredentialed teachers; and to provide for
 
 8 staggered terms for board members.
 
 9      SECTION 2.  Section 302A-501, Hawaii Revised Statutes, is
 
10 amended by amending subsection (b) to read as follows:
 
11      "(b)  For the purposes of sections 302A-801 to 302A-808:
 
12      "Board" means the Hawaii teacher standards board.
 
13      "Credential" means an emergency or temporary license issued
 
14 under this chapter based on standards and guidelines set by the
 
15 board.
 
16      "License" means the document signifying the board's grant of
 
17 permission to practice the profession of teaching.
 
18      "Teacher" means an employee of the department paid under the
 
19 salary schedule contained in the unit 5 collective bargaining
 
20 agreement.

 1      [This subsection is repealed on June 30, 2000.]"
 
 2      SECTION 3.  Section 302A-808, Hawaii Revised Statutes, is
 
 3 amended to read as follows:
 
 4      "[[]�302A-808[]]  Penalty.  Any person who engages in the
 
 5 profession of teaching in a public school without first being
 
 6 issued a license or credential shall be fined not more than $500.
 
 7 Any person who knowingly or intentionally violates this subpart
 
 8 by employing an individual as a public school teacher who does
 
 9 not possess a valid license or credential may be fined not more
 
10 than $500.  All fines under this section shall be a debt owing to
 
11 the State, shall be collected by the attorney general, and shall
 
12 be deposited into the Hawaii teacher standards board revolving
 
13 fund."
 
14      SECTION 4.  Act 122, Session Laws of Hawaii 1996, section 7,
 
15 is amended to read as follows:
 
16      "SECTION 7.  This Act shall take effect upon its approval,
 
17 except that section 2 shall take effect retroactive to July 1,
 
18 1995[, and shall be repealed on June 30, 2000]."
 
19      SECTION 5.  Section 302A-809, Hawaii Revised Statutes, is
 
20 repealed.
 
21      ["[�302A-809]  Repeal.  This subpart D, sections 302A-801 to
 
22 302A-809, is repealed on June 30, 2000."]
 
23      SECTION 6.  Upon the expiration of the terms of the current

 1 members of the Hawaii teacher standards board, the terms of new
 
 2 members appointed the Hawaii teacher standards board shall be
 
 3 staggered so as to provide for the expiration of an equal number
 
 4 of terms at intervals of one year.
 
 5      SECTION 7.  Statutory material to be repealed is bracketed.
 
 6 New statutory material is underscored.
 
 7      SECTION 8.  This Act shall take effect upon its approval.
