                   A  BILL  FOR  AN  ACT

MEDICAL RESEARCH ON CANCER STUDIES.


BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 324-21, Hawaii Revised Statutes, is
 
 2 amended to read as follows:
 
 3      "�324-21  Sources of information protected.  Any person,
 
 4 public or private medical facility, or social or educational
 
 5 agency, may provide information, interviews, reports, statements,
 
 6 memoranda, or other data or relevant material relating to
 
 7 individuals with cancer to the Hawaii Tumor Registry.  Such
 
 8 information may be used in the course of any cancer research
 
 9 study approved by the cancer commission of the Hawaii Medical
 
10 Association.
 
11      Hospitals, skilled nursing homes [and], intermediate care
 
12 homes, free-standing radiation oncology facilities, and other
 
13 treatment or pathology facilities shall submit a report of any
 
14 person admitted with or diagnosed as having cancer to the Hawaii
 
15 Tumor Registry [on a form] or participating hospital registry
 
16 according to a format approved by the cancer commission of the
 
17 Hawaii Medical Association.  Physicians who diagnose or treat a
 
18 patient for cancer shall also submit a report to the Hawaii Tumor
 
19 Registry or participating hospital registry unless the patient
 
20 has previously been admitted or treated at a hospital, skilled

 1 nursing home, intermediate care home, or free-standing radiation
 
 2 oncology facility for that particular cancer.  The Hawaii Tumor
 
 3 Registry staff or their representative or hospital-based registry
 
 4 staff may assist such hospitals [and], institutions, treatment or
 
 5 pathology facilities, and physician offices in the preparation of
 
 6 such [report forms.] reports.
 
 7      No liability of any kind or character for damages or other
 
 8 relief shall arise or be enforced against any person or
 
 9 organization by reason of having provided the information or
 
10 material, or by reason of having released or published the
 
11 findings, conclusions, and summaries of the researchers to
 
12 advance medical research and medical education."
 
13      SECTION 2.  Statutory material to be repealed is bracketed.
 
14 New statutory material is underscored.
 
15      SECTION 3.  This Act shall take effect upon its approval.
