                   A  BILL  FOR  AN  ACT

RELATING TO MEDICAL INSURANCE COVERAGE. 


BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  The legislature finds that there is a paramount
 
 2 concern that the right of all people in Hawaii to have access to
 
 3 health care in all its facets, including alternative care, is
 
 4 being impaired.  The legislature further finds that there is a
 
 5 heavy reliance by the public upon health insurance policies to
 
 6 provide adequate medical care, however, current policies exclude
 
 7 alternative health care and treatment from licensed providers.
 
 8      The purpose of this Act is to require health insurance
 
 9 policies to provide coverage for services from licensed
 
10 acupuncturists, chiropractors, naturopaths, and certified
 
11 dieticians. 
 
12      SECTION 2.  Chapter 431:10A, Hawaii Revised Statutes, is
 
13 amended by adding a new section to be appropriately designated
 
14 and to read as follows:
 
15      "�431:10A-    Coverage for alternative health care services.
 
16 Each policy of accident and sickness insurance issued or renewed
 
17 in this State, each employer group health policy, contract, plan,
 
18 or agreement issued or renewed in this State, all health
 
19 insurance policies issued or renewed in this State, all policies

 1 providing family coverages as defined in section 431:10A-103, and
 
 2 all policies providing reciprocal beneficiary family coverage as
 
 3 defined in section 431:10A-601, shall provide coverage for
 
 4 services performed by a licensed acupuncturist, chiropractor, or
 
 5 naturopath, or a certified dietician; provided that the services
 
 6 performed are within the lawful scope of the provider's practice.
 
 7 Coverage shall be on the same basis as any other care."
 
 8      SECTION 3.  Chapter 432:1, Hawaii Revised Statutes, is
 
 9 amended by adding a new section to be appropriately designated
 
10 and to read as follows:
 
11      "�432:1-    Coverage for alternative health care services.
 
12 All individual and group hospital and medical service plan
 
13 contracts and medical service corporation contracts under this
 
14 chapter shall provide coverage for services performed by a
 
15 licensed acupuncturist, chiropractor, or naturopath, or a
 
16 certified dietician; provided that the services performed are
 
17 within the lawful scope of the provider's practice.  Coverage
 
18 shall be on the same basis as any other care."
 
19      SECTION 4.  Section 432D-23, Hawaii Revised Statutes, is
 
20 amended to read as follows:
 
21      "�432D-23  Required provisions and benefits.
 
22 Notwithstanding any provision of law to the contrary, each
 
23 policy, contract, plan, or agreement issued in the State after

 1 January 1, 1995, by health maintenance organizations pursuant to
 
 2 this chapter, shall include benefits provided in sections
 
 3 431:10-212, 431:10A-115, 431:10A-115.5, 431:10A-116,
 
 4 431:10A-116.5, 431:10A-116.6, 431:10A-119, 431:10A-  , and,
 
 5 431:10-120, and chapter 431M."
 
 6      SECTION 5.  New statutory material is underscored.
 
 7      SECTION 6.  This Act shall take effect upon its approval.
