                   A  BILL  FOR  AN  ACT

ESTABLISHING A COMMISSION TO CELEBRATE THE ONE-HUNDREDTH
   ANNIVERSARY OF THE ARRIVAL OF THE KOREANS TO HAWAII.
 


BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  The legislature finds that members of the Korean
 
 2 community have contributed significantly and substantially to
 
 3 Hawaii.  Since the arrival of the first Koreans in Hawaii in
 
 4 1903, the rich culture and proud heritage of the Korean people
 
 5 have been and continue to be positive influences upon life in
 
 6 Hawaii.  The year 2003 will mark the one-hundredth anniversary of
 
 7 their arrival in Hawaii. In recognition of the great
 
 8 contributions of the Koreans to our diverse and multicultural
 
 9 society, a celebration to commemorate their arrival and
 
10 subsequent achievements in Hawaii is appropriate.  
 
11      The purpose of this Act is to provide for the celebration of
 
12 the centennial anniversary of the Korean people in Hawaii.
 
13      SECTION 2.  Creation of the Korean centennial celebration
 
14 commission.  There is established a temporary commission to be
 
15 known as the Korean centennial celebration commission which shall
 
16 have charge of all arrangements for the commemoration of the
 
17 centennial anniversary of the arrival of the first Koreans to
 
18 Hawaii.  The commission shall be placed within the office of the

 1 governor for administrative purposes and shall cease to operate
 
 2 after December 31, 2003.
 
 3      SECTION 3.  Membership, compensation.  The commission shall
 
 4 consist of fifteen members of the Korean community to be
 
 5 appointed by the governor without regard to section 26-34, Hawaii
 
 6 Revised Statutes.  The  members shall represent government,
 
 7 labor, business, culture and the arts, and the community at
 
 8 large.  The governor shall designate the chair of the commission
 
 9 from among the appointed members.  The members shall not receive
 
10 compensation for their services but shall be reimbursed for
 
11 necessary expenses, including travel expenses, incurred in the
 
12 performance of their duties under this Act.
 
13      SECTION 4.  Powers and duties.  The commission shall prepare
 
14 an overall program to celebrate the centennial anniversary of the
 
15 arrival of the Korean people in Hawaii, their significant
 
16 contributions to the development of this State, and their culture
 
17 and heritage.  The commission shall develop, plan, and coordinate
 
18 the various program activities that are to be scheduled
 
19 throughout the year of the celebration and shall encourage the
 
20 participation of all segments of the Korean community.  In
 
21 fulfilling its responsibilities, the commission shall consult,
 
22 cooperate with, and seek advice from appropriate Korean

 1 organizations and agencies.
 
 2      The commission shall submit to the governor a comprehensive
 
 3 report for the centennial anniversary celebration which shall
 
 4 include:
 
 5      (1)  The production, publication, and distribution of books,
 
 6           films, and other educational materials on the life and
 
 7           experiences of Koreans in Hawaii;
 
 8      (2)  Conferences, convocations, lectures, and seminars; and
 
 9      (3)  Traveling exhibits, other exhibits, ceremonies,
 
10           theatrical productions, and other special events
 
11           commemorating the anniversary.
 
12      SECTION 5.  Trust fund established.  There is hereby created
 
13 a trust fund to be known as the Korean ethnic celebration trust
 
14 fund which shall consist of payments made to the trust fund as
 
15 provided in this Act.  All moneys received by the commission
 
16 shall be deposited by the state director of finance into the
 
17 trust fund and expended by the commission for the purposes of
 
18 this Act.  Disbursement of such moneys shall be by state warrants
 
19 issued in accordance with applicable laws and rules and shall be
 
20 based on vouchers signed by the chair of the commission.
 
21      The commission may seek grants from public and private
 
22 sources and may accept donations to finance the projects,

 1 programs, and activities of the centennial anniversary
 
 2 celebration.  Any funds received shall be deposited in the Korean
 
 3 ethnic celebration trust fund.
 
 4      All property acquired by the commission shall be deposited
 
 5 for preservation in the state library system, museums, and public
 
 6 archives or shall otherwise be disposed of as directed by the
 
 7 commission.
 
 8      SECTION 6.  Final report.  At the end of its term, the
 
 9 commission shall submit to the governor a final report of all its
 
10 activities, including an accounting of all moneys received and
 
11 disbursed.
 
12      SECTION 7.  This Act shall take effect on July 1, 2000.
