                   A  BILL  FOR  AN  ACT

RELATING TO A LONG-TERM CARE COMMISSION. 


BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Chapter 26, Hawaii Revised Statutes, is amended
 
 2 by adding two new sections to part II to be appropriately
 
 3 designated and to read as follows:
 
 4      "�26-    Long-term care commission established.  (a)  There
 
 5 is established within the office of the lieutenant governor for a
 
 6 special purpose the commission for long-term care, disability,
 
 7 and elderly services.
 
 8      (b)  The governor shall appoint, without regard to chapters
 
 9 76, 77, and 89, an executive director for the commission for
 
10 long-term care, disability, and elderly services.  The executive
 
11 director's salary shall be established by the lieutenant governor
 
12 and within the range of salaries paid deputy directors of the
 
13 departments of the State.  The executive director shall be a
 
14 member of the state employees' retirement system and shall be
 
15 eligible to receive the benefits of any state or federal benefit
 
16 program generally applicable to officers and employees of the
 
17 State.
 
18      (c)  The executive director may hire professional staff,
 
19 whether full-time or part-time, or a combination thereof, without

 1 regard to chapters 76, 77, and 89, to assist the director to
 
 2 carry out the functions and duties of the commission; provided
 
 3 that administrative staff shall be furnished by the office of the
 
 4 lieutenant governor.
 
 5      �26-    Functions and duties of commission; membership.  (a)
 
 6 The commission for long-term care, disability, and elderly
 
 7 services shall:
 
 8      (1)  Coordinate all long-term care, disability, and elderly
 
 9           services functions of the State, including adult
 
10           protection services but not including insurance matters
 
11           under the jurisdiction of the insurance commissioner or
 
12           matters under the jurisdiction of the department of
 
13           taxation;
 
14      (2)  Conduct research and make recommendations to the
 
15           governor and the legislature on policy and funding
 
16           issues concerning improving the delivery of long-term
 
17           care, disability, and elderly services;
 
18      (3)  Act in a planning capacity for long-term care,
 
19           disability, and elderly services, with respect to:
 
20           (A)  The assessment of existing resources and unmet
 
21                needs primarily on a service basis rather than a
 
22                category basis;
 
23           (B)  The development of outcome-based quality

 1                assessment models for long-term care;
 
 2           (C)  Reducing the fragmentation of long-term care
 
 3                services and enhancing access to long-term care
 
 4                services; and
 
 5           (D)  Maximization of public and private funds for
 
 6                long-term care, disability, and elderly services;
 
 7                and
 
 8      (4)  Engage, as appropriate, in grant writing and technical
 
 9           assistance to support the activities of the commission
 
10           and to provide assistance to public and private
 
11           agencies and organizations involved with long-term
 
12           care, disability, and elderly services.
 
13      (b)  The commission for long-term care, disability, and
 
14 elderly services shall be composed of thirteen members to be
 
15 appointed by the governor, as follows:
 
16      (1)  Director of human services, or designee;
 
17      (2)  Director of health, or designee;
 
18      (3)  Director of transportation, or designee;
 
19      (4)  Director of labor and industrial relations, or
 
20           designee;
 
21      (5)  Director of the executive office on aging;
 
22      (6)  Chairperson, or executive secretary, if any, of the
 
23           state planning council on developmental disabilities;

 1      (7)  One representative of the disability and communication
 
 2           access board; and
 
 3      (8)  One representative of each of the following:
 
 4           (A)  Consumers of long-term care services;
 
 5           (B)  Consumers of disability services; and
 
 6           (C)  Consumers of elderly services;
 
 7      (9)  One representative of each of the following:
 
 8           (A)  Providers of long-term care services;
 
 9           (B)  Providers of disability services; and
 
10           (C)  Consumers of elderly services."
 
11      SECTION 2.  There is appropriated out of the general
 
12 revenues of the state of Hawaii the sum of $       , or so much
 
13 thereof as may be necessary for fiscal year 2000-2001, for
 
14 start-up funds for the commission for long-term care, disability,
 
15 and elderly services.
 
16      The sum appropriated shall be expended by the office of the
 
17 lieutenant governor.
 
18      SECTION 3.  New statutory material is underscored.
 
19      SECTION 4.  This Act shall take effect upon its approval;
 
20 provided that section 2 shall take effect on July 1, 2000.
