                   A  BILL  FOR  AN  ACT

RELATING TO CORRECTIONS.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Chapter 353, Hawaii Revised Statutes, is amended
 
 2 by adding a new section to be appropriately designated and to
 
 3 read as follows:
 
 4      "�353-     Earned time.  (a)  Earned time, not to exceed ten
 
 5 days for every month of incarceration, may be deducted from an
 
 6 inmate's sentence upon a demonstration to the department by the
 
 7 inmate, which is certified by the inmate's case manager, that the
 
 8 inmate has made consistent progress in each of the following
 
 9 categories:
 
10      (1)  Work and vocational or occupational training, including
 
11           attendance, promptness, performance, cooperation, care
 
12           of materials, and safety;
 
13      (2)  Social adjustment, including group living,
 
14           housekeeping, personal hygiene, and cooperation;
 
15      (3)  Participation in counseling sessions and involvement in
 
16           self-help groups;
 
17      (4)  Progress toward the goals and participation in
 
18           therapeutic or other programs established by the
 
19           department; and

 1      (5)  Positive progress, in accordance with performance
 
 2           standards established by the department in the
 
 3           education or literacy program.
 
 4      (b)  The department shall develop objective standards for
 
 5 measuring consistent progress in the categories listed in
 
 6 subsection (a).  The standards shall be applied in all
 
 7 evaluations of inmates for the earned time authorized in this
 
 8 section.
 
 9      (c)  For each inmate committed to the custody of the
 
10 director, the department shall review the performance record of
 
11 the inmate and may grant, withhold, withdraw, or restore,
 
12 consistent with the provisions of this section, an earned time
 
13 deduction from the sentence imposed.  The review shall be
 
14 conducted annually while the person is incarcerated and shall
 
15 vest upon being granted.  In addition to any other sanctions, the
 
16 director may refer to the prosecutor's office of the appropriate
 
17 county all cases where the inmate tests positive for the presence
 
18 of drugs.
 
19      (d)  Notwithstanding any other provision of this section,
 
20 earned time may not reduce the sentence of any inmate by a period
 
21 of time which is more than twenty-five per cent of the sentence."
