                   A  BILL  FOR  AN  ACT

RELATING TO STATE OWNED PUBLIC HOUSING. 


BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  The State is responsible for managing public
 
 2 housing.  The new federal housing law requires that tenants be
 
 3 represented on a public housing agency board.  It is good public
 
 4 policy to organize tenants and provide them with the ability to
 
 5 develop self-sufficiency.
 
 6      The purpose of this Act is to establish a statewide tenant
 
 7 advisory board and from this board select a chairperson to
 
 8 represent the tenants' interests on the board of the housing and
 
 9 community development corporation of Hawaii.
 
10      SECTION 2.  Chapter 201G, Hawaii Revised Statutes, is
 
11 amended by adding a new section to be appropriately designated
 
12 and to read as follows:
 
13      "�201G-    Statewide tenant advisory board.  (a)  There is
 
14 created a board designated as the statewide tenant advisory
 
15 board.  The advisory board shall be comprised of members
 
16 representing tenants of each public housing project.  Residents
 
17 of each public housing project shall select a single advisory
 
18 board member in an annual, anonymous election funded by the
 
19 housing and community development corporation.

 1      (b)  Upon convening, the advisory board shall select a
 
 2 chairperson who shall represent the advisory board's interest on
 
 3 the board of the housing and community development corporation of
 
 4 Hawaii established in 201G-3.
 
 5      (c)  Attendance at an advisory board meeting, greater than
 
 6 fifty per cent, shall constitute a quorum, whose affirmative vote
 
 7 shall be necessary for all actions by the advisory board.  The
 
 8 advisory board members shall receive no compensation for
 
 9 services, but shall be entitled to necessary expenses, including
 
10 travel expenses, incurred in the performance of their duties
 
11 which shall be satisfied out of the state low income housing
 
12 revolving fund established under section 201G-45."
 
13      SECTION 3.  Section 201G-3, Hawaii Revised Statutes, is
 
14 amended by amending subsection (a) to read as follows:
 
15      "(a)  There is created a board consisting of [nine] ten
 
16 members, of whom six shall be public members appointed by the
 
17 governor as provided in section 26-34.  Public members shall be
 
18 appointed from each of the counties of Honolulu, Hawaii, Maui,
 
19 and Kauai. One public member shall be the chairperson of the
 
20 rental housing trust fund advisory commission.  The public
 
21 members of the board shall serve four-year staggered terms;
 
22 provided that the initial appointments shall be as follows:  two
 
23 members to be appointed for four years; two members to be

 1 appointed for three years; and one member to be appointed for two
 
 2 years.  The chairperson of the rental housing trust fund advisory
 
 3 commission shall serve a concurrent term on the board.  The
 
 4 director of business, economic development, and tourism and the
 
 5 director of human services, or their designated representatives,
 
 6 [and] a representative of the governor's office, and the
 
 7 chairperson of the statewide tenant advisory board established in
 
 8 section 201G-  , shall be ex officio voting members.  The
 
 9 corporation shall be headed by the board."
 
10      SECTION 4.  Statutory material to be repealed is bracketed.
 
11 New statutory material is underscored.
 
12      SECTION 5.  This Act shall take effect upon its approval.
