                   A  BILL  FOR  AN  ACT

RELATING TO IDENTIFICATION DOCUMENTS.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Chapter 710, Hawaii Revised Statutes, is amended
 
 2 by adding a new section to be appropriately designated and to
 
 3 read as follows:
 
 4      "�710-     Sale or manufacture of deceptive identification
 
 5 document; penalties.  (1)  A person commits the offense of sale
 
 6 or manufacture of deceptive identification document if the person
 
 7 intentionally or knowingly manufactures, offers for sale,
 
 8 furnishes, offers to be furnished, transports, offers to be
 
 9 transported, or imports or offers to be imported into this State,
 
10 a deceptive identification document unless there is, diagonally,
 
11 in bold capital letters across the face of the document, in not
 
12 less than one-eighth of an inch in height and printed
 
13 conspicuously and permanently on the document in permanent ink,
 
14 the statement, "NOT A GOVERNMENT DOCUMENT", and, also printed
 
15 conspicuously and permanently on the document, the name of the
 
16 manufacturer.
 
17      (2)  As used in this section, "deceptive identification
 
18 document" means any document not issued by a governmental agency
 
19 of this State or any political subdivision thereof, another

 1 state, or the federal government, which purports to be, or which
 
 2 might deceive a reasonable person into believing that it is, a
 
 3 document issued by such an agency, including, but not limited to,
 
 4 a driver's license, identification card, birth certificate,
 
 5 passport, or social security card.
 
 6      (3)  Any person who violates subsection (1) shall be guilty
 
 7 of a class C felony.
 
 8      (4)  Any property used or intended for use in the commission
 
 9 of, attempt to commit, or conspiracy to commit an offense under
 
10 this section, or which facilitated or assisted such activity,
 
11 shall be forfeited subject to the requirements of chapter 712A."
 
12      SECTION 2.  New statutory material is underscored.
 
13      SECTION 3.  This Act shall take effect upon its approval.
