                   A  BILL  FOR  AN  ACT

RELATING TO THE HOUSING AND COMMUNITY DEVELOPMENT CORPORATION OF
   HAWAII.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  The purpose of this Act is to comply with the
 
 2 Quality Housing and Work Responsibility Act of 1998, P.L. 105-
 
 3 276, 112 Stat. 2461, by establishing resident advisory boards in
 
 4 federal public housing projects.  In addition, this Act will add
 
 5 a federal public housing or recipient of federal housing benefits
 
 6 to the to the housing and community development corporation of
 
 7 Hawaii's board of directors.
 
 8      SECTION 2.  Chapter 201G, Hawaii Revised Statutes, is
 
 9 amended by adding a new section to be appropriately designated
 
10 and to read as follows:
 
11      "�201G-    Resident advisory boards.  The corporation may
 
12 establish a resident advisory board or boards, which shall be
 
13 comprised of federal public housing residents or section 8
 
14 tenant-based recipients, to assist and advise the corporation in
 
15 matters relating to the planning and administration of federal
 
16 housing programs.  The members of the resident advisory board or
 
17 boards shall adequately reflect and represent residents of
 
18 federal public housing projects and recipients of section 8
 
19 benefits administered by the corporation.

 1      The corporation may adopt rules in accordance with chapter
 
 2 91 with respect to the establishment of the resident advisory
 
 3 board or boards including, but not limited to, rules concerning
 
 4 the composition, eligibility, selection, and term of members."
 
 5      SECTION 3.  Section 201G-3, Hawaii Revised Statutes, is
 
 6 amended by amending subsection (a) to read as follows:
 
 7      "�201G-3 Board; establishment, functions, duties.(a)
 
 8 There is created a board consisting of [nine] eleven members, of
 
 9 whom [six] eight shall be public members appointed by the
 
10 governor as provided in section 26-34.  Public members shall be
 
11 appointed from each of the counties of Honolulu, Hawaii, Maui,
 
12 and Kauai.  One public member shall be the chairperson of the
 
13 rental housing trust fund advisory commission.  One public member
 
14 shall be a person who is directly assisted by the corporation
 
15 under the federal low-rent public housing or federal section 8
 
16 tenant-based housing assistance payments program while serving on
 
17 the board.  The public members of the board shall serve four-year
 
18 staggered terms; provided that the initial appointments shall be
 
19 as follows: two members to be appointed for four years; two
 
20 members to be appointed for three years; and one member to be
 
21 appointed for two years.  The chairperson of the rental housing
 
22 trust fund advisory commission shall serve a concurrent term on
 
23 the board.  The director of business, economic development, and

 1 tourism and the director of human services, or their designated
 
 2 representatives, and a representative of the governor's office,
 
 3 shall be ex officio voting members.  The corporation shall be
 
 4 headed by the board.
 
 5      (b)  The board of directors shall select a chairperson and
 
 6 vice-chairperson from among its members.  The director of
 
 7 business, economic development, and tourism or the director of
 
 8 human services shall be ineligible to serve as chairperson of the
 
 9 board.
 
10      (c)  [Five] six members shall constitute a quorum, whose
 
11 affirmative vote shall be necessary for all actions by the
 
12 corporation.  The members shall receive no compensation for
 
13 services, but shall be entitled to necessary expenses, including
 
14 travel expenses, incurred in the performance of their duties."
 
15      SECTION 4.  Statutory material to be repealed is bracketed.
 
16 New statutory material is underscored.
 
17      SECTION 5.  This Act shall take effect upon its approval.
