                   A  BILL  FOR  AN  ACT

RELATING TO EDUCATION.


BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 302A-1128, Hawaii Revised Statutes, is
 
 2 amended by amending subsection (b) to read as follows:
 
 3      "(b)  The department shall regulate the courses of study to
 
 4 be pursued in all grades of public schools and classify them by
 
 5 methods the department deems proper; provided that:
 
 6      (1)  The course of study and instruction shall be regulated
 
 7           in accordance with the statewide performance standards
 
 8           established under section 302A-201;
 
 9      (2)  All pupils shall be progressively competent in the use
 
10           of computer technology; and
 
11      (3)  The course of study and instruction for the first
 
12           twelve grades shall enable all students to meet
 
13           progressive standards of competency in a language in
 
14           addition to English.
 
15      For the purposes of this subsection, the terms
 
16 "progressively competent in the use of computer technology" and
 
17 "progressive standards of competency in a language in addition to
 
18 English" shall be defined by policies adopted by the board
 
19 through rules adopted pursuant to chapter 91, with reference to
 
20 relevant national or international standards of competency.

 1 Notwithstanding paragraphs (2) and (3) to the contrary, the board
 
 2 [through rules adopted pursuant to chapter 91,] shall formulate
 
 3 statewide educational policies allowing the superintendent to
 
 4 exempt certain students from the requirements of paragraphs (2)
 
 5 and (3).  The statewide educational policies shall be exempt from
 
 6 the adoption, amendment, and repeal procedures in chapter 91."
 
 7      SECTION 2.  Statutory material to be repealed is bracketed.
 
 8 New statutory material is underscored.
 
 9      SECTION 3.  This Act shall take effect upon its approval.
