                   A  BILL  FOR  AN  ACT

RELATING TO DRIVER LICENSE RENEWAL BY MAIL.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 286-107, Hawaii Revised Statutes, is
 
 2 amended as follows:
 
 3      1.  By amending subsection (a) to read:
 
 4      "(a)  The examiner of drivers may accept an application for
 
 5 a renewal of a driver's license made not more than six months
 
 6 prior to the date of expiration.
 
 7      If, however, the renewal is not applied for within ninety
 
 8 days after the expiration of the license, the applicant for
 
 9 renewal shall be treated as an applicant for [a new license and
 
10 examined as provided in section 286-108.] reactivation of an
 
11 expired license under section 286-107.5."
 
12      2.  By amending subsection (c) to read:
 
13      "(c)  Any [resident of this State] person who holds a
 
14 category (1), (2), or (3) license [and who by reason of the
 
15 resident's temporary absence from the State] issued under this
 
16 part who is unable to appear in person before the examiner of
 
17 drivers to apply for a renewal of the [resident's] their driver's
 
18 license, may, if the [resident] person is not disqualified from
 
19 renewing the [resident's] license under subsection (a), apply for

 1 a renewal by mail.  The [resident's] applicant's request to have
 
 2 the [resident's] license renewed by mail must be received by the
 
 3 examiner of drivers within ninety days after the expiration of
 
 4 the [resident's] license[.] or be treated as an applicant for
 
 5 reactivation of an expired license under section 286-107.5.  The
 
 6 examiner of drivers shall upon receipt of the request, furnish
 
 7 the applicant with all necessary forms and instructions.  An
 
 8 application for renewal made pursuant to this subsection shall be
 
 9 accompanied by a statement from a licensed physician certifying
 
10 that the applicant had been examined by the licensed physician
 
11 not more than six months prior to the expiration date of the
 
12 applicant's license and that the applicant had been found by such
 
13 examination to have met the physical requirements established by
 
14 the state director of transportation for the renewal of licenses.
 
15 The application for renewal shall also be accompanied by:
 
16      (1)  A notarized statement of the applicant certifying
 
17          [(A)  To the fact that the applicant is a resident of
 
18                this State; and
 
19           (B)  To] to the fact that the applicant does not
 
20                possess any valid license to operate the same or
 
21                similar category or categories of motor vehicles,
 
22                issued by another licensing authority (unless such

 1                license is concurrently surrendered); and
 
 2      (2)  Such other information as may be required by the
 
 3           examiner of drivers which is reasonably necessary to
 
 4           confirm the identity of the applicant and the
 
 5           applicant's fitness to continue to operate a motor
 
 6           vehicle."
 
 7      3.  By amending subsection (g) to read:
 
 8      "(g)  No driver's license shall be renewable by mail [for]
 
 9 more than [two consecutive renewals] once after appearing in
 
10 person before the examiner of drivers whether the license
 
11 expires, under section 286-106, on the sixth birthday after
 
12 issuance or fourth birthday after issuance or on the second
 
13 birthday after issuance; provided that this subsection shall not
 
14 apply to a resident military person or that person's immediate
 
15 family if the resident military person resides outside the State
 
16 on official military orders."
 
17      SECTION 2.  Statutory material to be repealed is bracketed.
 
18 New statutory material is underscored.
 
19      SECTION 3.  This Act shall take effect upon its approval.
