                   A  BILL  FOR  AN  ACT

RELATING TO UNAUTHORIZED USE OF ANOTHER PERSON'S INFORMATION TO
   OBTAIN SERVICES.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Chapter 708, Hawaii Revised Statutes, is amended
 
 2 by adding a new section to be appropriately designated and to
 
 3 read as follows:
 
 4      "�708-    Unauthorized use of another person's information
 
 5 to obtain services.  (1)  A person commits the offense of
 
 6 unauthorized use of another person's information to obtain
 
 7 services if the person makes or causes to be made, either
 
 8 directly or indirectly, any false statement with the unauthorized
 
 9 use of another person's information in writing, by voice, or by
 
10 electronic transmission, knowing it to be false with the intent
 
11 that it be relied on, in respect to the person's identity or that
 
12 of any other person, for the purpose of obtaining services.
 
13      (2)  Unauthorized use of another person's information to
 
14 obtain services is a misdemeanor.
 
15      (3)  Unauthorized use of another person's information to
 
16 obtain services is a class C felony if the value of the money,
 
17 goods, or services obtained or attempted to be obtained exceeds
 
18 $300 in any six-month period."

 1      SECTION 2.  This Act does not affect rights and duties that
 
 2 matured, penalties that were incurred, and proceedings that were
 
 3 begun, before its effective date.
 
 4      SECTION 3.  New statutory material is underscored.
 
 5      SECTION 4.  This Act shall take effect upon its approval.
