DESCRIPTION:
Sets aside interest earned by the educational facilities
improvement special fund to be used solely for education
technology; gives legislature authority to authorize projects;
requires the special fund to retain the interest generated by the

                   A  BILL  FOR  AN  ACT

RELATING TO EDUCATION.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 36-32, Hawaii Revised Statutes, is
 
 2 amended by amending subsection (a) to read as follows:
 
 3      "(a)  There is created in the treasury of the State the
 
 4 state educational facilities improvement special fund, into which
 
 5 shall be deposited a portion of all general excise tax revenues
 
 6 collected by the department of taxation under section 237-31.
 
 7 All interest earned by moneys from this special fund shall be
 
 8 retained by the special fund.  The special fund shall be used
 
 9 solely to plan, design, acquire lands for and to construct public
 
10 school facilities and to provide equipment and technology
 
11 infrastructure to improve public schools and other facilities
 
12 under the jurisdiction of the department of education, except
 
13 public libraries[.]; provided that the interest earned on moneys
 
14 deposited into the fund shall be used solely for education
 
15 technology.  In addition, activities of the department of
 
16 education intended to eliminate the gap between the facility
 
17 needs of schools and available resources shall be eligible for
 
18 funding from the special fund.  Expenditures from the special
 
19 fund shall be limited to projects authorized by the legislature

 1 [and shall be subject to sections 37-31, and 37-33 through
 
 2 37-40].  Appropriations or authorizations from the special fund
 
 3 shall be expended by the comptroller.
 
 4      "Educational technology" includes educational computer
 
 5 software, computers, and related equipment for use in a formal
 
 6 educational setting as well as computer hardware and software
 
 7 designed for use with the Internet."
 
 8      SECTION 2.  Statutory material to be repealed is bracketed.
 
 9 New statutory material is underscored.
 
10      SECTION 3.  This Act shall take effect upon its approval.
