DESCRIPTION:
Requires the DCCA to establish agreements with all access
organizations to oversee the development, operation, supervision,
management, production, and broadcasting over the cable PEG
channels.  Requires the DCCA to establish a board for each

                   A  BILL  FOR  AN  ACT

RELATING TO PUBLIC ACCESS TELEVISION.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 440G-8.2, Hawaii Revised Statutes, is
 
 2 ]amended by amending subsection (f) to read as follows:
 
 3      "(f)  The cable operator shall designate three or more
 
 4 channels for public, educational, or governmental use.  The
 
 5 director shall establish agreements with access organizations to
 
 6 oversee the development, operation, supervision, management,
 
 7 production, and broadcasting of programs for any channels
 
 8 designated under this subsection.  Those agreements shall
 
 9 establish a governing board of directors by the following means:
 
10      (1)  One member appointed ex-officio by the cable operators;
 
11      (2)  One member appointed by the University of Hawaii board
 
12           of regents;
 
13      (3)  One member appointed by the board of education;
 
14      (4)  Two members appointed by the governor and confirmed by
 
15           the senate; and
 
16      (5)  Five members elected by the community that the access
 
17           organization serves.
 
18      Those agreements shall designate the access organizations as
 
19 instrumentality of the state and obligate the access

 1 organizations to abide by, and be subject to chapter 92F."
 
 2      SECTION 2.  Statutory material to be repealed is bracketed.
 
 3 New statutory material is underscored.
 
 4      SECTION 3.  This Act shall take effect upon its approval.
