                   A  BILL  FOR  AN  ACT

RELATING TO HEALTH CARE INFORMATION.
 


BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Chapter 323C, Hawaii Revised Statutes, is
 
 2 amended by adding a new section to be appropriately designated
 
 3 and to read as follows:
 
 4      "�323C-     Health care information.  (a)  There is
 
 5 established a revolving fund within the state treasury to be
 
 6 administered by the director of the office of information
 
 7 practices and to be designated as the health care information
 
 8 revolving fund.
 
 9      (b)  The director may expend moneys from the health care
 
10 information revolving fund for the regulation of health care
 
11 information, including but not limited to the hiring of
 
12 professional, technical, and support staff and education.
 
13      (c)  Beginning with fiscal year 2000-2001 and each fiscal
 
14 year thereafter, each entity governed by this chapter, except a
 
15 government agency, shall transmit to the director no later than
 
16 July 1, of each year an assessment, based on a pro rata basis, to
 
17 be determined and imposed by the director; provided that the
 
18 assessment for fiscal year 2000-2001 shall be paid no later than
 
19 September 30, 2000.  The aggregate annual assessment shall not

 1 exceed $600,000.  The assessment shall be credited to the health
 
 2 care information revolving fund.
 
 3      (d)  The director shall report annually to the legislature
 
 4 before the convening of each regular session concerning the fund
 
 5 administration and expenditures.
 
 6      (e)  The director may adopt rules in accordance with chapter
 
 7 91 to effectuate the purposes of this section."
 
 8      SECTION 2.  Upon approval of this Act, each entity described
 
 9 in section 323C-  (c), Hawaii Revised Statutes, shall transmit to
 
10 the director of the office of information practices no later than
 
11 September 30, 2000, a one-time assessment in an amount to be
 
12 determined by the director, which shall be credited to the health
 
13 care information revolving fund; provided that the aggregate
 
14 amount of all assessments shall not exceed $600,000.
 
15      SECTION 3.  There is appropriated out of the health care
 
16 information revolving fund the sum of $600,000, or so much
 
17 thereof as may be necessary for fiscal year 2000-2001, to carry
 
18 out the purposes of this Act.  The sum appropriated shall be
 
19 expended by the office of information practices for the purposes
 
20 of this Act.
