Requires notification of parents, except in cases of emergency,
when minors seek and consent to medical care to treat sexually
transmitted diseases and pregnancy, and obtain family planning

                   A  BILL  FOR  AN  ACT
RELATING TO MEDICAL CARE FOR MINORS.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:


 1      SECTION 1.  Section 577A-3, Hawaii Revised Statutes, is
 
 2 amended to read as follows:
 
 3      "�577A-3 Providing information.  [Public] Except in cases
 
 4 of emergency, public and private hospitals, or public and private
 
 5 clinics or physicians licensed to practice medicine [may, at the
 
 6 discretion of the treating physician,] shall inform the spouse,
 
 7 parent, custodian, or guardian of any minor patient of the
 
 8 provision of medical care and services to the minor [or] and
 
 9 disclose any information pertaining to such care and services
 
10 after [consulting with] informing the minor patient to whom such
 
11 medical care and services have been provided under this chapter.
 
12      [If] Except in cases of emergency, if the minor patient is
 
13 not diagnosed as being pregnant or afflicted with [venereal] a
 
14 sexually transmitted disease, such information as well as the
 
15 application for diagnosis [may] shall also be disclosed[, at the
 
16 discretion of the treating physician] to the spouse, parent,
 
17 custodian, or guardian of any minor patient after [consulting
 
18 with] informing the minor patient."
 
19      SECTION 2.  Statutory material to be repealed is bracketed.
