Traffic Code


DESCRIPTION:
Makes it a violation to fail to appear at the place and within
the time specified in the summons or citation issued by an
authorized police officer for any traffic violation, or to fail
to appear for any subsequent answer, hearing, or trial date duly

                   A  BILL  FOR  AN  ACT

RELATING TO THE TRAFFIC CODE.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Chapter 291C, Part XV, Hawaii Revised Statutes,
 
 2 is amended by adding a new section to be appropriately designated
 
 3 and to read as follows:
 
 4      "�291C-     Failure to appear.  Any person who fails to
 
 5 appear at the place and within the time specified in the summons
 
 6 or citation issued to the person by an authorized police officer
 
 7 for any traffic violation, or who fails to appear for any
 
 8 subsequent answer, hearing, or trial date duly set by the court
 
 9 for the traffic violation, is guilty of a violation as provided
 
10 in section 701-107(5), regardless of the disposition of the
 
11 charge for which the person was originally cited; provided that
 
12 this section shall not apply to any traffic infraction defined in
 
13 chapter 291D.  Nothing in this section shall be construed to
 
14 affect the power of the court to regulate its proceedings and to
 
15 punish any person whose failure to appear delays proceedings
 
16 before the court."
 
17      SECTION 2.  New statutory material is underscored.
 
18      SECTION 3.  This Act shall take effect on July 1, 1999.
