                    SENATE  CONCURRENT
                        RESOLUTION

  REQUESTING THE OFFICE OF INFORMATION PRACTICES TO CONVENE A
    TASK FORCE ON HEALTH CARE INFORMATION PRIVACY.


 1        WHEREAS, Act 87, Session Laws of Hawaii, 1999, established
 2   the protection of health care information in Hawaii, and is now
 3   codified as chapter 323C, Hawaii Revised Statutes; and
 4   
 5        WHEREAS, Section 5 of Act 87 requires the Office of
 6   Information Practices (OIP) to draft rules required by the Act;
 7   and
 8   
 9        WHEREAS, the OIP has expressed interest in working with
10   interested members of the community to move forward on drafting
11   rules to implement chapter 323C; and
12   
13        WHEREAS, the OIP had begun meeting with health care
14   industry representatives and other interested parties to obtain
15   their valuable input for the rule drafting process; and
16   
17        WHEREAS, the resources available to the OIP have been
18   strained by its increasingly broad duties; and
19   
20        WHEREAS, the knowledge of the health care community and
21   other interested parties will be invaluable to the OIP in
22   analyzing health care information issues and in drafting the
23   rules required by Act 87; now, therefore,
24   
25        BE IT RESOLVED by the Senate of the Twentieth Legislature
26   of the State of Hawaii, Regular Session of 2000, the House of
27   Representatives concurring, that the OIP is requested to
28   convene a task force to advise and assist the office of
29   information practices in drafting rules to implement the
30   requirements of chapter 323C, Hawaii Revised Statutes; and
31   
32        BE IT FURTHER RESOLVED that the Director of the OIP shall
33   be the chair of the task force; and
34   
35        BE IT FURTHER RESOLVED that the members of the task force
36   may include, but are not limited to, participants in any prior
37   task force that studied the issue of health care information
38   privacy, interested members of the community, and health care
39   organizations, and that the office of information practices may
40   invite any person or entity to participate in the task force;

 2        BE IT FURTHER RESOLVED that the OIP is requested to submit
 3   a report to the legislature twenty days prior to the convening
 4   of the 2001 regular session, regarding its progress in drafting
 5   rules to implement the requirements of chapter 323C, Hawaii
 6   Revised Statutes; and
 7   
 8        BE IT FURTHER RESOLVED that certified copies of this
 9   Concurrent Resolution be transmitted to the Governor and the
10   Director of the OIP.
