                    SENATE  CONCURRENT
                        RESOLUTION

  REQUESTING THE IMPLEMENTATION OF A SYSTEM-WIDE MASTER PLAN AND
    AN ACCOMPANYING INFORMATIONAL STUDY, ADDRESSING THE
    CURRENT AND PROJECTED NEED FOR PRISON FACILITIES IN
    HAWAII.


 1        WHEREAS, the Legislature finds that there is a need for
 2   the efficient use of the current prison and detention
 3   facilities, as well as a need for the State to build new prison
 4   and detention facilities to accommodate the overflowing number
 5   of inmates that are currently being sent to mainland prisons
 6   under contracts with the State; and
 7   
 8        WHEREAS, the Legislature finds that the State will realize
 9   a substantial economic benefit if State resources are used and
10   spent within the State for the construction and support of
11   State prison and detention facilities; and
12   
13        WHEREAS, the Legislature finds that a system-wide master
14   plan will help the State realize its goals for the development
15   and maintenance of the State prison system; and
16   
17        WHEREAS, the Legislature finds that a study (Study)
18   determining the operational and design objectives of the
19   existing and projected facilities is essential to the
20   development of a system-wide master plan; and
21   
22        WHEREAS, the Legislature further finds that incorporating
23   testimony and information from the Counties regarding zoning
24   and other County regulations into the Study is essential to the
25   development of a system-wide master plan; and
26   
27        WHEREAS, the purpose of this Concurrent Resolution is to
28   request the creation of a master plan which will incorporate
29   the findings of the Study and address four major categories as
30   follows:

32        (1)  Mission and objectives of all pre-trial and
33             sentencing components of the Department of Public
34             Safety;

 1        (2)  Population profiles, projections, and bed needs with
 2             and without the use of alternatives to incarceration;
 3   
 4        (3)  Evaluation of existing facilities to determine bed
 5             capacity based on state and national standards and
 6             necessary improvements based on fire and life safety,
 7             and applicable building codes; and
 8   
 9        (4)  The development of a ten year master plan for the use
10             of current facilities, additions, renovations, and
11             new facilities based on population projections and
12             the effect of alternatives to incarceration, taking
13             into account the effect that additions, renovations,
14             and new facilities may have on the Counties;
15   
16   now, therefore,
17   
18        BE IT RESOLVED by the Senate of the Twentieth Legislature
19   of the State of Hawaii, Regular Session of 2000, the House of
20   Representatives concurring, that a system-wide master plan be
21   designed and implemented and the accompanying Study be
22   conducted by the master plan executive committee assisted by
23   the Department of Public Safety and appropriate agencies or
24   departments to ensure the efficient maintenance and development
25   of Hawaii's prison system; and
26   
27        BE IT FURTHER RESOLVED that the Study be directed by the
28   master plan executive committee appointed by the Governor
29   consisting of members representing the Department of Public
30   Safety, the Executive Branch of the State, State Legislative
31   Corrections or the Judiciary Committee, and State Health and
32   Mental Health agencies; and
33   
34        BE IT FURTHER RESOLVED that the master plan executive
35   committee is directed to:
36   
37        (1)  Fund the Study by raising funds through private
38             partnerships;
39   
40        (2)  Hire a consultant qualified to advise the committee
41             regarding the design and management of prison and
42             detention facilities; and

 2        (3)  Make the Study available to the Office of the
 3             Governor, the Regular Session of 2001 of the
 4             Legislature, the Department of Public Safety, and
 5             other concerned departments or agencies;
 6   
 7   and
 8   
 9        BE IT FURTHER RESOLVED that the master plan executive
10   committee, be assisted by members of the Department of Public
11   Safety with experience in areas such as security, work
12   programs, physical and mental health treatment, prison
13   facilities management, prisoner intake and classification and
14   rehabilitation, and superintendents of existing Department of
15   Public Safety facilities; and
16   
17        BE IT FURTHER RESOLVED that the master plan executive
18   committee be directed to provide data, viable recommendations,
19   or options to the master plan executive committee; and
20   
21        BE IT FURTHER RESOLVED that the Department of Public
22   Safety assign additional personnel to assist the master plan
23   executive committee in areas such as population projections,
24   unique operational issues, and prison facility evaluations; and
25   
26        BE IT FURTHER RESOLVED that all State departments,
27   Counties, and governmental organizations shall cooperate with
28   the Study and provide requested information in a timely manner
29   to the master plan executive committee; and
30   
31        BE IT FURTHER RESOLVED that the master plan executive
32   committee report its findings and recommendations to the
33   Legislature twenty days before the convening of the Regular
34   Session of 2001; and
35   
36        BE IT FURTHER RESOLVED that certified copies of this
37   Concurrent Resolution be transmitted to the Office of the
38   Governor, the Chief Justice of the Hawaii Supreme Court, the
39   President of the Senate, the Speaker of the House of
40   Representatives, the Director of Health, the Director of Public
41   Safety, and the Mayor of each county.
