A BILL FOR AN ACT

 

RELATING TO THE UNIVERSITY OF HAWAII.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. The legislature finds that the Hawaiian language college was established at the University of Hawaii (UH) at Hilo in 1997, to serve as focal point for the revitalization of the Hawaiian language. Currently, however, UH is required to contract with the research corporation of the University of Hawaii (RCUH) to provide management and other services to support UH's research and training activities, when neither it nor another state agency can accomplish this.

The legislature further finds that the Hawaiian language college has determined that its business be conducted in the Hawaiian language; however, RCUH is set up to operate in the English language. Therefore, this being a matter of statewide concern, an exception should be made to allow the Hawaiian language college to contract directly with qualified providers.

The purpose of this Act is authorize the UH college of Hawaiian language to contract directly with providers, such as Aha Punana Leo, Inc., when conducting business in the Hawaiian language.

SECTION 2. Section 304-10.5, Hawaii Revised Statutes, is amended by amending subsection (a) to read as follows:

"(a) Notwithstanding any law to the contrary, when the university determines that neither the university nor another state agency can more effectively or efficiently accomplish the purposes of the sponsored research and training activities, the university shall contract with the [Research Corporation] research corporation of the University of Hawaii established under chapter 307 to provide management and other services as described in subsection (b) to support the university's research and training activities[.]; except that when conducting business in the Hawaiian language, the Hawaiian language college may contract directly with providers, such as Aha Punana Leo, Inc. Contracts by the university with the research corporation pursuant to this section shall be limited to sponsored research and training projects, except that university projects supported by state-appropriated funds may also be contracted to the research corporation pursuant to rules adopted by the university."

SECTION 3. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.

SECTION 4. This Act shall take effect upon its approval.
