A BILL FOR AN ACT

 

relating to transportation.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Chapter 291C, Hawaii Revised Statutes, is amended by adding two new sections to be appropriately designated and to read as follows:

"§291C- Towing of vehicle without current certificate of registration or current certificate of inspection. (a) Upon the issuance of a citation for operating, permitting or causing the operation of, or parking a vehicle on a public highway without a current certificate of registration issued pursuant to part III of chapter 286, or a current certificate of inspection issued pursuant to part II of chapter 286, a police officer may cause the vehicle to be towed away at the expense of the vehicle's registered owner if:

(1) The vehicle's certificate of registration or certificate of inspection, or both, has been expired for more than twelve months; and

(2) The vehicle is unoccupied and has not been reported by its registered or legal owner as having been stolen.

(b) A motor or other vehicle towed away pursuant to this section may be claimed by its registered or legal owner upon the full payment of all towing and storage charges.

(c) This section is supplemental to any statute of the State regarding the registration or inspection of vehicles.

(d) This section shall not apply to counties with less than three hundred motor vehicles, trailers, and semi-trailers for every one mile of paved or unpaved road.

§291C- Towing of motor vehicle operated by person without current driver's license. (a) Upon the issuance of a citation for operating a motor vehicle on a public highway without a current driver's license issued pursuant to part VI of chapter 286, a police officer may cause the motor vehicle to be towed away at the expense of the motor vehicle's registered owner if:

(1) The driver's license of the individual operating the motor vehicle has been expired for more than twelve months; and

(2) There is no other individual in the motor vehicle who is currently licensed and able to safely operate the motor vehicle.

(b) A motor vehicle towed away pursuant to this section may be claimed by its registered or legal owner upon the full payment of all towing and storage charges.

(c) This section is supplemental to any statute of the State regarding motor vehicle driver licensing.

(d) This section shall not apply to counties with less than two hundred ninety-two motor vehicles for every one mile of paved or unpaved road."

SECTION 2. This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun, before its effective date.

SECTION 3. New statutory material is underscored.

SECTION 4. This Act shall take effect upon its approval.
