A BILL FOR AN ACT

 

RELATING TO education.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Chapter 302A, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§302A- Teachers' right to know. (a) The exclusive representatives of bargaining units (5) and (6) shall prepare and maintain records of the amount of all wages and salaries and union-paid benefits provided to all employees of the exclusive representatives of bargaining units (5) and (6).

(b) The exclusive representatives shall make those records available for inspection to any public employee covered under bargaining units (5) and (6) within twenty-eight days after receiving a written request for inspection by any public employee covered under bargaining units (5) or (6).

(c) A fine of $100 per day shall be assessed against an exclusive representative for each day after the twenty-eight day period that the exclusive representative fails to provide to any public employee covered under bargaining units (5) or (6) access to the requested records.

(d) For purposes of this section, the following terms are defined as follows:

"Available" means available for inspection at no cost upon written request received at the business address of the exclusive representative.

"Union-paid benefits" means any payment by the exclusive representative to a bargaining unit employee, former bargaining unit employee, or dependent of a bargaining unit employee or former bargaining unit employee which would not have been made if the bargaining unit employee or former bargaining unit employee had not been employed by the exclusive representative."

SECTION 2. New statutory material is underscored.

SECTION 3. This Act shall take effect on July 1, 2001.
