HOUSE CONCURRENT

RESOLUTION

 

REQUESTING a report on the status of the native hawaiian rehabilitation fund.

 

 

WHEREAS, the native Hawaiian rehabilitation fund was created under the Hawaiian Homes Commission Act; and

WHEREAS, the Constitution of the State of Hawaii requires that thirty per cent of the state receipts derived from the leasing of cultivated sugarcane lands shall be transferred to the native Hawaiian rehabilitation fund, as well as thirty per cent of the revenues whenever such lands are sold, developed, leased, utilized, transferred, set aside, or otherwise disposed of; and

WHEREAS, the Department of Hawaiian Home Lands is directed to use the money in the native Hawaiian rehabilitation fund solely for the educational, economic, political, social, and cultural needs of the native Hawaiian population; and

WHEREAS, an accounting of the fund is necessary to assure that the requirements of the Constitution and Hawaii Homes Commission Act are complied with; now, therefore,

BE IT RESOLVED by the House of Representatives of the Twenty-first Legislature of the State of Hawaii, Regular Session of 2001, the Senate concurring, that the Department of Hawaiian Home Lands is requested to provide a detailed report on the native Hawaiian rehabilitation fund, including the source and amount of all funds deposited in it for the last five years, and expenditure report, and a report detailing the impact of the various projects and programs funded through the fund, for the purpose of ascertaining compliance with the State Constitution; and

BE IT FURTHER RESOLVED that the Department present its report to the Legislature at least twenty days before the convening of the Regular Session of 2002; and

BE IT FURTHER RESOLVED that a certified copy of this Concurrent Resolution be transmitted to the Chairperson of the Hawaiian Homes Commission.
