A BILL FOR AN ACT

 

relating to education.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Chapter 302A, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§302A- Pearl City high school cultural center reserve account. (a) There is established in the state treasury an account to be known as the Pearl City high school cultural center reserve account, into which shall be deposited per cent of the moneys derived from this school run business venture. Moneys in the reserve account shall not be commingled with moneys in other treasury accounts or with Pearl City high school's other moneys. Moneys in the reserve account shall be appropriated for the purposes of, and shall be expended by the school for, the repair and maintenance of the Pearl City high school cultural center, including the purchase of necessary equipment and supplies.

(b) Notwithstanding subsection (a) to the contrary, the director of finance shall transfer from the Pearl City high school cultural center reserve account to the state general fund, any amount over $ . The transfer of these excess moneys from the reserve account to the state general fund shall be completed by the director of finance not more than twenty days after the end of the fiscal year. This subsection shall not be construed to exempt the reserve account from the requirements of sections 36-27 and 36-30."

SECTION 2. New statutory material is underscored.

SECTION 3. This Act shall take effect on July 1, 2001.
