A BILL FOR AN ACT

 

relating to substance abuse schools.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Chapter 302A, Hawaii Revised Statutes, is amended by adding a new section to part IV, subpart C, to be appropriately designated and to read as follows:

"§302A-   Substance abuse schools; establishment. Beginning July 1, 2002, the department shall designate or establish, as appropriate, one or more substance abuse middle schools and one or more substance abuse high schools in each school district that are dedicated solely for the education of students who are determined by the department or by the family court, as needing substance abuse services. A substance abuse school shall provide a program of instruction that meets the minimum educational requirements of the department for each grade through a specialized curriculum and a learning environment that are sensitive to the special needs of the enrolled students.

As used in this section:

"Substance abuse" has the same meaning as in section 321-191.

"Substance abuse services" means the provision of medical, psychological, counseling, or therapeutic services, or a combination of these services, in response to alcohol or drug dependence, or both."

SECTION 2. There is appropriated out of the general revenues of the State of Hawaii, the sum of $          , or so much thereof, as may be necessary for fiscal year 2001-2002, for the planning of substance abuse schools, and the sum of $          , or so much thereof, as may be necessary for fiscal year 2002-2003, for the establishment of substance abuse schools, including the hiring of personnel and contracting of services.

The sums appropriated shall be expended by the department of education for the purposes of this Act.

SECTION 3. New statutory material is underscored.

SECTION 4. This Act shall take effect upon its approval; provided that section 2, shall take effect on July 1, 2001.
