A BILL FOR AN ACT

 

relating to education.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. The legislature finds that vacancies in financial management, property management, and other specialized positions that do not require an education background in the department of education are often filled with individuals within the education field. This method of employee selection often results in hiring of department personnel who are initially not knowledgeable in the field of certain key administrative, technical, and professional positions.

To avoid an extended period of on the job training or extensive training programs required by individuals employed in administrative, technical, and professional positions, the legislature finds that the department should implement a hiring policy that recruits and considers individuals from the private sector, the universities, and the mainland, where appropriate or necessary. In addition to implementing a recruitment and hiring policy that considers all qualified applicants, the department should institute a career development and training program for designated key positions to ensure the most competent managers in administrative, technical, and professional offices.

SECTION 2. Chapter 302A, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§302A- Positions subject to open recruitment. (a) The department shall adopt and implement an open recruitment policy in the employment of specialized professional administrative, technical, and operational positions. The department shall designate administrative, technical, and professional positions subject to open recruitment. The superintendent shall provide to the legislature an annual report on the status of the positions designated for open recruitment.

(b) The department shall institute and implement a career development and training program for positions designated as subject to open recruitment.

(c) Positions designated as subject to open recruitment shall require a commitment to remain in the position for a stated period of time as a condition to employment. The department shall determine the period of time commitment required as a condition for employment for each designated position.

(d) For purposes of this section, "open recruitment" means the recruitment and consideration of individuals for designated administrative, technical, and professional positions who may not have a professional background or experience in the field of education."

SECTION 3. New statutory material is underscored.

SECTION 4. This Act shall take effect upon its approval.
