A BILL FOR AN ACT

 

relating to special education.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. In order to move as expeditiously as possible towards full compliance with the Felix Consent Decree regarding special education in Hawaii's public schools, it is imperative that the department have a mechanism by which the special education needs of entering students can be assessed.

The purpose of this Act is to require the department to provide special education evaluations of all students prior to their entering the public school system.

SECTION 2. Chapter 302A, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§302A- Special education evaluation required. No child shall be admitted to any public school for the first time in the State unless the child has undergone a special education evaluation to be provided by the department. The department shall develop uniform evaluation standards appropriate to the child's age."

SECTION 3. New statutory material is underscored.

SECTION 4. This Act shall take effect upon its approval.
