Sir:

Your Committee on Judiciary, to which was referred Governor's Message No. 241, submitting for study and consideration the nomination of:

COMMISSION TO PROMOTE UNIFORM LEGISLATION

LANI LIU EWART, for a term to expire June 30, 2005,

begs leave to report as follows:

Upon review of the testimony and statements submitted by the nominee, your Committee finds that the nominee has the necessary character, experience, and qualifications to serve on the Commission to Promote Uniform Legislation (Commission).

Your Committee received testimony in support of the nominee from the Attorney General and a private citizen.

Your Committee notes the following background and qualifications of the nominee.

The nominee received a Bachelor of Arts degree from the University of Hawaii at Manoa and a Juris Doctor degree from the University of California, Boalt Hall School of Law. She is a partner with Goodsill Anderson Quinn & Stifel. She is licensed to practice law in Hawaii and California. She is a member of the Honolulu Symphony Society and Honolulu Community Theatre.

The nominee has been a member of the Commission since 1984, currently serving as Vice-Chair. In recognition of her dedicated service to the promotion of uniform laws, she was elected in 1998 by the Commission to Life Membership in the National Conference. She is the first woman commissioner life member in the 106-year history of the Conference. The nominee has participated in the drafting of such legislation as the Nonjudicial Foreclosure Act and Revised Uniform Commercial Code Article 9 on Secured Transactions, and has appeared numerous times before the Hawaii Legislature to testify.

As affirmed by the record of votes of the members of your Committee on Judiciary that is attached to this report, your Committee, after full consideration of the background, character, experience, and qualifications of the nominee, has found the nominee to be qualified for the position to which nominated and recommends that the Senate advise and consent to the nomination.
