Your Committee on Tourism and Intergovernmental Affairs, to which was referred H.B. No. 22, H.D. 2, entitled:

"A BILL FOR AN ACT RELATING TO TIME SHARING PLANS,"

begs leave to report as follows:

The purposes of this measure are to exclude persons employed by or in contract with licensed real estate brokers or registered acquisition agents from the definition of "acquisition agent", to eliminate the registration requirement for these employees or contractors, to clarify that sales agents and acquisition agents are responsible for the actions of their employees, and to clearly provide that if a real estate broker's license is somehow lost or inactive, the broker may not act as a time share acquisition agent or sales agent.

Testimony in support of this measure was received from the Department of Commerce and Consumer Affairs, American Resort Development Association, The Bay Club Ownership Resort, and Pahio Resorts, Inc.

Your Committee finds that this measure will streamline the registration requirements for time share personnel, while continuing to ensure protection against any infractions of time share or other laws. Your Committee further finds that these changes represent a more efficient means of regulating time share personnel without compromising consumer protection procedures.

 

As affirmed by the record of votes of the members of your Committee on Tourism and Intergovernmental Affairs that is attached to this report, your Committee is in accord with the intent and purpose of H.B. No. 22, H.D. 2, and recommends that it pass Second Reading and be referred to the Committee on Commerce, Consumer Protection and Housing.
