Your Committees on Water, Land, Energy and Environment and Economic Development and Technology, to which was referred S.B. No. 1166 entitled:

"A BILL FOR AN ACT RELATING TO PENALTIES FOR THE STATEWIDE TRAIL AND ACCESS PROGRAM,"

beg leave to report as follows:

The purpose of this measure is to include both civil and administrative penalties for the statewide trail and access program.

Your Committees received testimony in support of this measure from the Department of Land and Natural Resources.

Your Committees find that there is increasing recreational pressure, both public and commercial, for trails and access roads throughout the State. A commercial permit process has been established, but compliance has been problematic.

Your Committees are supportive of this measure and believe the proposed penalties will provide much-needed protection for Hawaii's trails and access roads.

As affirmed by the records of votes of the members of your Committees on Water, Land, Energy and Environment and Economic Development and Technology that are attached to this report, your Committees are in accord with the intent and purpose of S.B. No. 1166 and recommend that it pass Second Reading and be referred to the Committee on Judiciary.
