Your Committee on Judiciary, to which was referred S.B. No. 1510 entitled:

"A BILL FOR AN ACT RELATING TO GAMBLING,"

begs leave to report as follows:

The purpose of this measure is to clarify the definition of "bookmaking" to include accepting bets from only one member of the public.

Your Committee received testimony in favor of this measure from the Honolulu Prosecuting Attorney. Your Committee received comments on this measure from the Honolulu Police Department.

Your Committee finds that the current provisions relating to "bookmaking" require that a person accept bets from members of the public. Thus, for the purposes of promoting gambling in the first degree which requires that the prosecution prove that a person received or accepted more than five bets totaling $500 in any seven day period, the bets would have to come from more than one person. This measure will make it easier to prove gambling offenses since the five bets totaling $500 in the seven-day period can involve just one member of the public.

As affirmed by the record of votes of the members of your Committee on Judiciary that is attached to this report, your Committee is in accord with the intent and purpose of S.B. No. 1510 and recommends that it pass Second Reading and be placed on the calendar for Third Reading.
