Sir:

Your Committee on Judiciary, to which was referred S.B. No. 1555 entitled:

"A BILL FOR AN ACT RELATING TO ACT 316, SESSION LAWS OF HAWAII 1993, AS AMENDED BY ACT 157, SESSION LAWS OF HAWAII 1995,"

begs leave to report as follows:

The purpose of this measure is to prevent inadvertent repeal of probation laws by adding reenactment language to laws that were amended by laws establishing the expedited sentencing program and scheduled to "drop dead".

Your Committee received testimony in support from the Judiciary and written comments on this measure from the Legislative Reference Bureau.

Your Committee finds that in the course of its statutory revision function, the Legislative Reference Bureau has uncovered these laws that will be repealed on June 30, 2001, unless the Legislature takes affirmative steps to avoid or forestall their repeal. Moreover, it appears that the total repeal of these laws was not originally intended by the Legislature, but was instead inadvertent, and that the failure to amend these laws will result in further ambiguity as to their intended disposition.

As affirmed by the record of votes of the members of your Committee on Judiciary that is attached to this report, your Committee is in accord with the intent and purpose of S.B. No. 1555 and recommends that it pass Second Reading and be placed on the calendar for Third Reading.
