Sir:

Your Committees on Transportation, Military Affairs and Government Operations and Judiciary, to which was referred S.B. No. 1606 entitled:

"A BILL FOR AN ACT RELATING TO DRIVING UNDER THE INFLUENCE OF INTOXICATING LIQUOR,"

beg leave to report as follows:

The purpose of this measure is to impose an additional and separate fine of $100 for driving under the influence of intoxicating liquor, to be used by law enforcement agencies for DUI enforcement.

Your Committees received testimony in support of this measure from the Department of Transportation, the Honolulu City and County Police Department, and the Honolulu City and County Department of the Prosecuting Attorney. The Office of the Public Defender submitted testimony expressing concerns regarding this measure.

Your Committees find that the additional $100 will greatly benefit law enforcement agencies charged with enforcing our drinking and driving laws. At the hearing on this measure, several officers testified that law enforcement personnel lack the necessary equipment to establish roadblock checkpoints regularly, and to videotape persons stopped on suspicion of drinking and driving.

Your Committees find that the extra revenue raised by this measure would enable law enforcement personnel to purchase video cameras and to set up checkpoints more regularly.

Your Committees made several technical, nonsubstantive amendments to this measure.

As affirmed by the records of votes of the members of your Committees on Transportation, Military Affairs and Government Operations and Judiciary that are attached to this report, your Committees are in accord with the intent and purpose of S.B. No. 1606, as amended herein, and recommend that it pass Second Reading in the form attached hereto as S.B. No. 1606, S.D. 1, and be referred to the Committee on Ways and Means.
