Your Committees on Tourism and Intergovernmental Affairs and Transportation, Military Affairs and Government Operations, to which was referred S.B. No. 190 entitled:

"A BILL FOR AN ACT RELATING TO COUNTIES,"

beg leave to report as follows:

The purpose of this measure is to exempt the counties from the requirement to publish a public notice in a publication determined by the comptroller.

Your Committees received testimony in support of this measure from Hawaii State Association of Counties, City and County of Honolulu, County of Maui, one member of the Maui County Council, one member of the Hawaii County Council, and Hawaii Newspaper Agency.

Your Committees find that Act 2, Session Laws of Hawaii 1998, was enacted to promote consistency and competition in the publication of non-procurement public notices of the State and the counties. However, the requirements have led to problems for the counties, particularly neighbor island counties.

Your Committees find that this measure allows the counties to select their own publications, and gives the various counties the flexibility to choose a publication more suited to the needs of their residents.

As affirmed by the records of votes of the members of your Committees on Tourism and Intergovernmental Affairs and Transportation, Military Affairs and Government Operations that are attached to this report, your Committees are in accord with the intent and purpose of S.B. No. 190 and recommend that it pass Second Reading and be referred to the Committee on Judiciary.
