Sir:

Your Committee on Transportation, Military Affairs and Government Operations, to which was referred S.B. No. 210, entitled:

"A BILL FOR AN ACT RELATING TO PILOTS,"

begs leave to report as follows:

The purpose of this measure is to require the director of commerce and consumer affairs to determine the number of pilots necessary to safely and efficiently meet the requirements of commerce, and to ensure that an adequate supply of pilots is maintained and licensed.

Your Committee received testimony in support of this measure from the department of commerce and consumer affairs, from the Hawaii Pilots Association, and from four individuals licensed as port pilots.

Prior to issuance of a legal opinion by the Office of the Attorney General in 2000, the need for port pilots was determined, and licensing conducted, in the manner proposed by this measure. This measure would restore prior practice.

Your Committee has amended this measure by adding a findings section and by making a technical, nonsubstantive amendment.

As affirmed by the record of votes of the members of your Committee on Transportation, Military Affairs and Government Operations that is attached to this report, your Committee is in accord with the intent and purpose of S.B. No. 210, as amended herein, and recommends that it pass Second Reading in the form attached hereto as S.B. No. 210, S.D. 1, and be referred to the Committee on Commerce, Consumer Protection and Housing.
