Sir:

Your Committees on Tourism and Intergovernmental Affairs and Transportation, Military Affairs and Government Operations, to which was referred S.B. No. 469 entitled:

"A BILL FOR AN ACT MAKING AN APPROPRIATION FOR PARKING FOR PERSONS WITH DISABILITIES,"

beg leave to report as follows:

The purpose of this measure is to appropriate an unspecified sum as a grant-in-aid to the counties for the administration of the program to issue removable windshield placards for parking to qualified persons with disabilities.

Your Committees received testimony in support of this measure from the Disability and Communication Access Board, City and County of Honolulu, Honolulu Police Department, and County of Hawaii.

Your Committees find that the Ninth U.S. Circuit Court of Appeals ruled that public entities may not legally charge persons with disabilities a fee for removable windshield parking placards. This leaves the counties with no means to recoup the administrative costs of this valuable service.

Your Committees further find that this measure would compensate the counties for the service they provide to persons with disabilities. Your Committees are supportive of this measure and have made a technical amendment to correct a drafting error.

As affirmed by the records of votes of the members of your Committees on Tourism and Intergovernmental Affairs and Transportation, Military Affairs and Government Operations that are attached to this report, your Committees are in accord with the intent and purpose of S.B. No. 469, as amended herein, and recommend that it pass Second Reading in the form attached hereto as S.B. No. 469, S.D. 1, and be referred to the Committee on Ways and Means.
