Sir:

Your Committee on Ways and Means, to which was referred S.B. No. 752, S.D. 1, entitled:

"A BILL FOR AN ACT RELATING TO STATE BOATING FACILITIES,"

begs leave to report as follows:

The purpose of this measure is to clarify certain issues concerning leases issued for lands within small boat harbors and other state boating facilities.

This bill provides that these leases may allow uses, other than maritime activities, that complement or support maritime uses within those facilities.

The bill further provides that all revenues from these leases are to be deposited into the boating special fund. The costs of operating, maintaining, and managing the small boat harbors are paid from the boating special fund. Generally, the source of revenues for that fund is mooring and other harbor use fees, lease rent, and the marine fuel tax. The state boating facilities depend on these sources of revenue, which are not readily increased.

Your Committee finds that allowing alternate, complementary uses within these small boat harbors and other state boating facilities is projected to increase revenues in the fund. Such an increase will allow the state boating facilities to continue to facilitate and expand recreational and commercial activity.

As affirmed by the record of votes of the members of your Committee on Ways and Means that is attached to this report, your Committee is in accord with the intent and purpose of S.B. No. 752, S.D. 1, and recommends that it pass Third Reading.
