A BILL FOR AN ACT

 

relating to the BOARD OF EDUCATION.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. The purpose of this Act is to propose amendments to article VII, section 1, and article X, section 3, of the Constitution of the State of Hawaii to authorize the board of education to set the rate of taxation in the manner provided by law.

SECTION 2. Article VII, section 1, of the Constitution of the State of Hawaii is amended to read as follows:

"TAXING POWER INALIENABLE

Section 1. [The] Except as provided in article X, section 3, the power of taxation shall never be surrendered, suspended or contracted away."

SECTION 3. Article X, section 3, of the Constitution of the State of Hawaii is amended to read as follows:

"POWER OF THE BOARD OF EDUCATION

Section 3. The board of education shall have the power, as provided by law, to [formulate]:

(1) Formulate statewide educational policy and appoint the superintendent of education as the chief executive officer of the public school system[.]; and

(2) Set the rate of taxation."

SECTION 4. The question to be printed on the ballot shall be as follows:

SECTION 5. Constitutional material to be repealed is bracketed and stricken. New constitutional material is underscored.

SECTION 6. This amendment shall take effect upon compliance with article XVII, section 3, of the Constitution of the State of Hawaii.
