A BILL FOR AN ACT

 

RELATING TO PUBLIC SERVICE.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Chapter 78, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§78- Leave of absence for bone marrow or organ donation. (a) Any employee of the State or any of the counties may be granted a leave of absence as follows:

(1) Five work days to serve as a bone marrow donor if the employee provides the employer with written verification that the employee is to serve as a bone marrow donor; and

(2) Thirty work days to serve as a human organ donor if the employee provides the employer with written verification that the employee is to serve as a human organ donor.

(b) An employee who is granted a leave of absence pursuant to this section shall receive the employee's base pay without interruption during the leave of absence.

(c) For purposes of determining seniority, pay or pay advancement, performance awards, and the receipt of any benefit that may be affected by the leave of absence taken under this section, the service of the employee shall be considered uninterrupted by the leave of absence.

(d) The employer shall not penalize an employee for requesting or obtaining a leave of absence pursuant to this section.

(e) The leave of absence authorized by this section may be requested by the employee only if the employee is the person who is serving as the donor."

SECTION 2. New statutory material is underscored.

SECTION 3. This Act shall take effect upon its approval.
