A BILL FOR AN ACT

 

relating to hawaii tourism authority.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. The legislature finds that the role of executive director of the Hawaii tourism authority has assumed an even more critical status since the events of September 11, 2001, which have had a devastating effect on Hawaii's tourism industry. As the authority proceeds in its search for a permanent executive director, attracting a dynamic and experienced individual for the position will be a decisive factor in the success of the authority to improve Hawaii's tourism industry and the overall state economy.

The purposes of this Act are to require senate confirmation of the executive director and to clarify the authority's role in the appointment of the position.

SECTION 2. Section 201B-2, Hawaii Revised Statutes, is amended by amending subsection (f) to read as follows:

"(f) The board shall appoint, with the advice and consent of the senate, an executive director, exempt from chapters 76 and [77,] 88, who shall oversee the authority staff, and shall be compensated at a salary level set by the governor[.]; provided that the salary shall not exceed fifteen per cent of the three per cent authorized for administrative expenses under section 201B-11(c); and provided further that the final compensation package shall not include private sector moneys or other contributions. The board shall set the executive director's duties, responsibilities, holidays, vacations, leaves, hours of work, and working conditions. It may grant such other benefits as it deems necessary."

SECTION 3. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.

SECTION 4. This Act shall take effect upon its approval.
