A BILL FOR AN ACT

 

relating to the Department of education storeroom and storeroom revolving fund.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. The legislature finds that the auditor, in the auditor's 2002 report on the department of education's storeroom, recommended the repeal of the statute that required establishment of the central storeroom and that created the storeroom revolving fund. The auditor's report also recommended that the board of education and the department of education eliminate the central storeroom. The purpose of this Act is to implement the auditor's recommendations.

SECTION 2. Section 302A-1304, Hawaii Revised Statutes, is repealed.

["[§302A-1304] Department of education storeroom; revolving fund. There shall be a storeroom established by the department to provide schools a source for commonly used educational, office, and custodial supplies. There is established a revolving fund to be known as the "storeroom revolving fund", into which shall be deposited the receipts from charges made to schools for the supplies and cost of issuing the supplies from the storeroom and transfers from other accounts or funds. Receipts and transfers deposited into the storeroom revolving fund may be expended to purchase educational, office, and custodial supplies, and equipment and services needed to operate the storeroom. Balances in excess of $400,000 at the end of each fiscal year shall lapse into the general fund."]

SECTION 3. The board of education and the department of education shall develop and implement a plan for the orderly and efficient closure, by July 1, 2002, of the department of education storeroom established under section 302A-1304, Hawaii Revised Statutes. The plan shall include:

(1) A process for liquidating, by July 1, 2002, all educational, office, or custodial supplies remaining in the department of education storeroom; and

(2) A process for transferring, by July 1, 2002, all appropriations, records, equipment, machines, files, supplies, contracts, books, papers, documents, maps, and other personal property heretofore made, used, acquired, or held by the department of education storeroom to the office of the superintendent of education.

SECTION 4. The superintendent of education shall transfer to the credit of the state general fund, all unexpended or unencumbered balances remaining in the department of education storeroom revolving fund, established under section 302A-1304, Hawaii Revised Statutes, prior to June 30, 2002.

SECTION 5. Statutory material to be repealed is bracketed and stricken.

SECTION 6. This Act shall take effect upon its approval; provided that section 2 shall take effect on July 1, 2002.
