A BILL FOR AN ACT

 

RELATING TO BOATING ENFORCEMENT.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Chapter 200, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§200- Enforcement. (a) The board of land and natural resources may delegate to harbor agents and recreation harbor managers of the division of boating and ocean recreation, in addition to the delegation of enforcement authority to conservation and resources enforcement officers appointed pursuant to chapter 199, authority to enforce this chapter and the rules adopted pursuant thereto by issuance of a summons and citation for any violation of this chapter and related rules. Harbor agents and recreation harbor managers of the division of boating and ocean recreation granted enforcement authority under this section shall not bear firearms. The enforcement authority granted to officers and employees of the department under this section shall not diminish the authority of other state and county officers charged with enforcement of state laws to enforce and assist in the enforcement of this chapter and all rules adopted pursuant to this chapter.

(b) Nothing herein shall preclude the enforcement of state or federal laws, rules, and regulations pursuant to agreements or other arrangements entered into between the chairperson and appropriate officers and agencies of the United States and other states to ensure the fullest possible cooperation in promoting and attaining the declared policy of section 200-21."

SECTION 2. New statutory material is underscored.

SECTION 3. This Act shall take effect upon its approval.
