A BILL FOR AN ACT

 

proposing amendments to the constitution of the state of hawaii regarding senate districts, the number of senators, and the breaking of tie votes in the senate.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. The purpose of this Act is to propose an amendment to article III, section 2, of the Constitution of the State of Hawaii to create twelve senatorial districts of two senators each, with tie votes broken by the lieutenant governor.

SECTION 2. Article III, section 2, of the Constitution of the State of Hawaii is amended to read as follows:

"COMPOSITION OF SENATE; TIE VOTES

Section 2. The senate shall be composed of [twenty-five] twenty-four members, who shall be elected by the qualified voters of the respective twelve senatorial districts[.]; provided that two members of the senate shall be elected from each such district. Until the next reapportionment the senatorial districts and the number of senators to be elected from each shall be as set forth in the Schedule. The lieutenant governor shall cast a vote to resolve an equally divided senate, but shall otherwise not be entitled to vote."

SECTION 3. The question to be printed on the ballot shall be as follows:

SECTION 5. This amendment shall take effect upon compliance with article XVII, section 3, of the Constitution of the State of Hawaii.
