HOUSE CONCURRENT

RESOLUTION

 

urging the department of land and natural resources to expedite the review and adoption of administrative rules to improve boating safety for children.

 

 

WHEREAS, the Legislature is concerned about the safety of children who are passengers on recreational vessels; and

WHEREAS, the Legislature has specific and well-founded concerns regarding the lack of appropriate flotation devices for children aboard these vessels; and

WHEREAS, the Governor has stated that boating safety regulation should be established through administrative rules, and not by statute; and

WHEREAS, the United States Coast Guard amended its rules, effective February 15, 2000, to require all children under the age of 13 to wear personal floatation devices while aboard recreational vessels; and

WHEREAS, the Department of Land and Natural Resources has drafted amended administrative rules which will improve boating safety; however, these rules have not received final approval and have not been adopted; now, therefore,

BE IT RESOLVED by the House of Representatives of the Twenty-first Legislature of the State of Hawaii, Regular Session of 2002, the Senate concurring, that the Department of Land and Natural Resources is urged to expedite the review and adoption of improved safety requirements for children on recreational vessels; and

BE IT FURTHER RESOLVED that these amended rules be in force prior to the convening of the Regular Session of 2003; and

BE IT FURTHER RESOLVED that a certified copy of this Concurrent Resolution be transmitted to the Chairperson of the Board of Land and Natural Resources.
