A BILL FOR AN ACT

 

relating to publication of notice.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Section 1-28.5, Hawaii Revised Statutes, is amended as follows:

1. By amending subsection (b) to read:

(b) For purposes of this section[, the]:

(1) The comptroller pursuant to chapter 103D shall determine a publication for [all] the government agencies of the State, the judiciary, the legislature, and the city and county of Honolulu, to enable the public to go to [one] a source of publication for published public notice on each island[.] for the State, the judiciary, and the legislature, and on the island of Oahu for the city and county of Honolulu;

(2) The directors of finance for each of the counties of Hawaii, Kauai, and Maui, pursuant to chapter 103D, shall determine a publication for their respective county government agencies to enable the public to go to for county-published public notices on each island and each county shall pay the direct cost of its county-issued notice; and

(3) Nothing in this section shall preclude the comptroller and the county directors of finance from entering into cooperative agreements for the publication of public notices."

2. By amending subsection (e) to read:

"(e) For purposes of this section, "government agency" means each department, board, commission, [or] officer of the State [or], any of its political subdivisions[.] , the judiciary, and the legislature."

SECTION 2. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.

SECTION 3. This Act shall take effect upon its approval, provided that this Act shall not have any effect on any contract implementing section 1-28.5, Hawaii Revised Statutes, entered into prior to the effective date.
