A BILL FOR AN ACT

 

Relating to education.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Section 302A-1143, Hawaii Revised Statutes, is amended to read as follows:

"[[]§302A-1143[]] Attend school in what district. (a) All persons of school age shall be required to attend the school of the district in which they reside, unless it appears to the department to be desirable to allow the attendance of pupils at a school in some other district, in which case the department may grant this permission.

(b) Department rules that grant priority consideration for specified reasons for geographic exceptions shall include, but not be limited to, granting geographic exceptions for:

(1) Foster children who would benefit from the continuation of education or education-related services, or both, in the school complex where the children are currently enrolled;

(2) Children who are adopted and would benefit from the continuation of education or education-related services, or both, in the school complex where the children are enrolled at the time of adoption;

(3) Children of a grandparent who:

(A) Resides in the receiving school's geographic attendance area; and

(B) Provides either before-school or after-school care for the children; and

(4) Children of full-time department staff who work within the school complex that contains the receiving school.

The reasons for priority consideration enumerated in this subsection and in department rules are not ranked and each shall be given equal consideration. All other requests to attend a school in some other district shall be considered only after priority requests have been accommodated.

(c) For the purposes of this section "receiving school" means the school outside the geographic area of the student's legal residence."

SECTION 2. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.

SECTION 3. This Act shall take effect on July 1, 2020.
