A BILL FOR AN ACT

 

relating to state small boat harbors.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Currently, small boat harbors, which are regulated by the board of land and natural resources, are subjected to a multitude of confusing and cumbersome administrative rules. While these rules may be necessary to implement legislative mandates and to comply with court decisions which have been made over the years, some rules have been shown to be superfluous, excessive, and costly.

In addition, user fees paid by the small boat harbors into the boating special fund are currently used for maintaining boating facilities around the State without regard to each particular facility's contribution to the fund.

The purpose of this Act is to:

(1) Allow the formation of small boat recreational harbor charters from small boat harbors;

(2) Require the small boat recreational harbor charters to have a repair and maintenance system using computer technology and a timetable;

(3) Require a special fund financial report of income and expenditures to be provided to the advisory board;

(4) Require that advisory board meetings organized by the department be recorded; and

(5) Establish a small boat recreational harbor charter board made up of nine elected residents of each small boat recreational harbor.

SECTION 2. Chapter 200, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§200-    Small boat recreational harbor charters. (a) Each small boat harbor may create a small boat recreational harbor charter by forming a board elected by the small boat harbor community. The department shall assist in the formation of the small boat recreational harbor charters.

(b) The small boat recreational harbor charter shall have a repair and maintenance system for the harbor using computer technology and a timetable. In creating this system, the department shall request the assistance of the department of education to share their repair and maintenance experience and plan.

(c) Each small boat recreational harbor charter may create a special fund which shall present a financial report of income and expenditures to the board of each small boat recreational harbor charter on a quarterly basis.

(d) Small boat recreational harbor charter advisory board meetings organized by the department shall be recorded.

(e) A small boat recreational harbor charter board shall be established, consisting of nine residents each elected by a small boat recreational harbor. The board shall be the policy making body for the small boat recreational harbor charter. The policies shall be subject to agreement by the board of land and natural resources. The small boat recreational harbor charter board shall report directly to the chair of the board of land and natural resources."

SECTION 3. New statutory material is underscored.

SECTION 4. This Act shall take effect on July 1, 3001.
