SENATE CONCURRENT

RESOLUTION

 

REQUESTING the department of health and the department OF human services to conduct a collaborative study to designate a single department to oversee the funding and regulation of adult residential care homes.

 

WHEREAS, Adult Residential Care Home (ARCH) facilities are an important option for adults who require living assistance in Hawaii; and

WHEREAS, the State has a compelling interest in ensuring that ARCH facilities are properly regulated so that they are able to deliver safe, quality, low cost care in the most efficient manner possible; and

WHEREAS, under existing law, ARCH facilities are funded under the Department of Human Services, while the Department of Health has primary responsibility to regulate ARCH facilities; and

WHEREAS, efficiency dictates that a single government agency oversee all aspects of ARCH facilities, so that an integrated, comprehensive system of regulation and funding can be emplaced; now, therefore,

BE IT RESOLVED by the Senate of the Twenty-first Legislature of the State of Hawaii, Regular Session of 2002, the House of Representatives concurring, that the Department of Health and the Department of Human Services conduct a collaborative study to determine the appropriate state agency to oversee both the funding and regulation of ARCH facilities; and

BE IT FURTHER RESOLVED that the study include proposed amendments to existing law necessary to effectuate the results of the study; and

BE IT FURTHER RESOLVED that the collaborative study conducted by the Department of Health and the Department of Human Services and any appropriate legislation be submitted to the Legislature no later than twenty days prior to the convening of the Regular Session of 2003; and

BE IT FURTHER RESOLVED that certified copies of this Concurrent Resolution be transmitted to the Director of Health and the Director of Human Services.
