HOUSE CONCURRENT

RESOLUTION

 

requesting that the department of land and natural resources conduct a study of lands located within or near the conservation district to evaluate and propose systematic measures to be taken to mitigate damages that may be caused by the natural erosion of land.

 

 

WHEREAS, each of the islands of the State of Hawaii is being eroded over time by the forces of nature; and

WHEREAS, as a result of this erosion, boulders and rocks have been falling from hillsides and ridge lands that are largely located within the State's Conservation District onto developed properties; and

WHEREAS, in many cases, the falling of boulders and rocks is not the result of actions taken by the owners of the lands on the hillsides or ridge lands; and

WHEREAS, risks to the public may have been created by developers who constructed residences and other improvements on lands within or contiguous to the Conservation District or in close proximity to lands subject to the natural erosion of land; and

WHEREAS, pursuant to chapters 183 and 205, Hawaii Revised Statutes, the Department of Land and Natural Resources governs the use of land within the Conservation District; and

WHEREAS, in the interest of public safety, there is a need for the Department of Land and Natural Resources to evaluate and propose systematic measures to be taken to mitigate damages that may be caused by developments constructed within or contiguous to the Conservation District or in close proximity to lands subject to natural erosion; now, therefore,

BE IT RESOLVED by the House of Representatives of the Twenty-second Legislature of the State of Hawaii, Regular Session of 2003, the Senate concurring, that the Department of Land and Natural Resources is requested to evaluate and propose measures to be taken to mitigate damage that may be caused by developments within or contiguous to the Conservation District or in close proximity to lands subject to natural erosion; and

BE IT FURTHER RESOLVED that certified copies of this Concurrent Resolution be transmitted to the Governor and the Chairperson of the Board of Land and Natural Resources.
