A BILL FOR AN ACT

 

relating to tourism.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. The legislature finds that from the first appropriation of $15,000 of public funds in 1903 to promote tourism by the territorial legislature, public funding has grown to over $60,000,000 in state funds annually. The expenditure of any public funds must be publicly accountable. The legislature believes that performance should be measured and evaluated against contract performance goals.

Thus, the purpose of this Act is to ensure that public funds spent on tourism marketing and promotion are spent wisely and in an effective manner by requiring the Hawaii tourism authority to include in each of its tourism marketing and promotion contracts performance goals and a requirement to measure the effectiveness of expenditures in reaching those goals.

SECTION 2. Chapter 201B, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§201B-    Measures of effectiveness; contractual requirement; reports. (a) To ensure accountability of the expenditure of public funds, the authority shall include in each of its contracts, in which any public funds are expended for tourism marketing or promotion, the following terms:

(1) Performance specifications that detail goals to be reached as a result of the expenditure of public funds;

(2) Monitoring specifications that detail when, how often, and in what manner contractual performance goals are to be monitored; and

(3) Measures of effectiveness specifications that detail the method or methods by which contract performance is to be assessed and evaluated, particularly in relation to the expenditure of public funds.

(b) The authority shall include in its annual report, as required in section 201B-16, the results of all contracts, in which any public funds are expended for tourism marketing or promotion, in terms of effectiveness as measured pursuant to subsection (a)."

SECTION 3. New statutory material is underscored.

SECTION 4. This Act shall take effect upon its approval.
